GDS Rule 3-C Gramin Dak Sevaks के लिए Voluntary Discharge से संबंधित महत्वपूर्ण provision है। अगर कोई GDS निर्धारित शर्तों के अनुसार अपनी engagement से स्वेच्छा से discharge होना चाहता है, तो Voluntary Discharge Scheme के provisions महत्वपूर्ण हो जाते हैं।
Department of Posts द्वारा जारी GDS (Conduct and Engagement) Rules, 2020 में Rule 3-C के अंतर्गत GDS के लिए Voluntary Discharge Scheme का provision दिया गया है। मूल Rule 3-C के अनुसार सभी categories के GDS निर्धारित instructions के अनुसार 20 वर्ष की engagement period पूरी होने पर या medical grounds पर Voluntary Discharge Scheme का लाभ ले सकते हैं।
Medical grounds वाली Voluntary Discharge Scheme में Department ने 25 February 2025 को महत्वपूर्ण संशोधन जारी किया। इसलिए वर्तमान स्थिति समझने के लिए केवल 2020 Rules या 2018 के पुराने OM को पढ़ना पर्याप्त नहीं है। Medical-ground cases में 2025 का updated OM भी देखना जरूरी है।
GDS Rule 3-C क्या है?
Rule 3-C – Voluntary Discharge Schemes GDS Rules 2020 का एक महत्वपूर्ण provision है। इसका उद्देश्य eligible Gramin Dak Sevaks को निर्धारित conditions के अधीन अपनी engagement से voluntary discharge लेने का रास्ता उपलब्ध कराना है।
मूल 2020 Rules में स्पष्ट किया गया है कि सभी categories के GDS 20 years of engagement period complete होने पर या medical grounds पर Department द्वारा समय-समय पर जारी instructions के अनुसार Voluntary Discharge Scheme का लाभ ले सकते हैं।
GDS Rule 3-C को मुख्य रूप से दो परिस्थितियों से समझा जा सकता है:
- 20 वर्ष की engagement पूरी होने के बाद voluntary discharge
- Medical grounds पर voluntary discharge

GDS के लिए Voluntary Discharge के मुख्य प्रकार
Voluntary Discharge Scheme को समझने के लिए इसे broadly दो हिस्सों में समझना उपयोगी है:
- Scheme-I: 20 वर्ष की engagement period पूरी होने के बाद voluntary discharge
- Scheme-II: Medical grounds पर voluntary discharge
2018 में Department ने सभी categories के GDS के लिए Voluntary Discharge Scheme संबंधी consolidated instructions जारी किए थे। इसमें 20 years वाली scheme और medical-ground scheme के लिए अलग provisions दिए गए थे।
Scheme-I: 20 वर्ष की Engagement के बाद Voluntary Discharge
2018 के Departmental OM में Scheme-I उन GDS के लिए रखी गई थी जो 20 years की qualifying engagement period पूरी करने के बाद prematurely engagement छोड़ना चाहते हैं।
20 वर्ष की Minimum Engagement
इस scheme में minimum qualifying engagement period 20 years निर्धारित की गई थी।
इसका मतलब यह है कि केवल कुछ वर्षों की सेवा के बाद सामान्य voluntary discharge के लिए इस particular scheme का लाभ नहीं लिया जा सकता। Applicable scheme conditions और engagement period की गणना को Department के latest instructions के अनुसार verify करना चाहिए।
क्या Age Restriction है?
2018 के Scheme-I instructions में कोई age restriction नहीं रखी गई थी। मुख्य eligibility condition qualifying engagement period से जुड़ी थी।
तीन महीने का Notice Period
Scheme-I के तहत voluntary discharge के लिए निर्धारित format में कम से कम तीन महीने का written notice Divisional Head को देना होता था, जैसा कि संबंधित scheme instructions में निर्धारित है।
Notice period, application format और competent authority से संबंधित practical procedure के लिए current departmental instructions/office orders देखना जरूरी है। पुराने scheme document को वर्तमान case में mechanically लागू नहीं करना चाहिए।
क्या Request को वापस लिया जा सकता है?
2018 Scheme-I instructions के अनुसार request को acceptance से पहले, prescribed conditions के अधीन, accepting authority की approval से withdraw किया जा सकता था।
किन मामलों में Scheme-I उपलब्ध नहीं थी?
2018 के consolidated instructions में बताया गया था कि यह scheme उन GDS के लिए उपलब्ध नहीं थी जो Put Off Duty पर थे या जिनके विरुद्ध disciplinary action, police case या court case pending था।
किसी वर्तमान case में लागू restrictions के लिए latest departmental instructions जरूर देखें।
Scheme-I में Discharge Benefits
2018 के instructions के अनुसार eligible GDS को normal discharge benefits engagement period के अनुपात में मिलने का provision था।
यदि GDS ने 20 years की engagement period पूरी नहीं की थी, तो उस scheme के अंतर्गत monetary benefits के संबंध में अलग restrictions थीं। इसलिए किसी individual case में benefit calculation करने से पहले applicable orders और service record देखना जरूरी है।
Scheme-II: Medical Grounds पर Voluntary Discharge
Medical-ground Voluntary Discharge उन परिस्थितियों से संबंधित है जहां GDS को ऐसी contagious disease अथवा bodily/mental infirmity हो जो उसे GDS engagement के लिए permanently incapacitate करती है।
इस विषय में Department ने 25 February 2025 को महत्वपूर्ण revised instructions जारी किए, जिन्होंने 2018 के medical-ground scheme के relevant provisions को modify किया।
2025 में Medical Voluntary Discharge में क्या बदलाव हुआ?
Department of Posts के OM No. 19-19/2024-GDS dated 25.02.2025 ने medical-ground Voluntary Discharge Scheme को modify किया। यह modification Rights of Persons with Disabilities Act, 2016 की Section 20 और Kerala High Court के 11 April 2024 के order के संदर्भ में जारी किया गया था।
2025 के revised scheme में medical condition वाले GDS के लिए दो options दिए गए हैं।
Option A – GDS Quit नहीं करना चाहता
यदि GDS medical condition के कारण अपने वर्तमान post पर suitable नहीं है, लेकिन वह engagement छोड़ना नहीं चाहता, तो उसे suitable alternative arrangement का option दिया गया है।
यदि acquired disability के कारण GDS अपने existing post के लिए suitable नहीं है, तो उसे उसके duties के लिए suitable किसी अन्य post पर shift किया जा सकता है, भले ही उस post का TRCA level अलग हो।
यदि suitable post उपलब्ध नहीं है, तो उसे suitable post उपलब्ध होने तक या 65 years की age तक, जो पहले हो, supernumerary post पर रखा जा सकता है, जैसा कि 2025 OM में निर्धारित है।
Option B – GDS Medical Grounds पर Quit करना चाहता है
यदि GDS medical condition के कारण engagement के लिए permanently incapacitated है और वह न तो किसी suitable alternative post पर जाना चाहता है और न ही supernumerary post पर retain होना चाहता है, तो revised scheme के तहत वह GDS engagement से permanently quit कर सकता है।
Medical Discharge के लिए Medical Examination
2025 के OM में medical examination की प्रक्रिया भी निर्धारित की गई है। Application प्राप्त होने के बाद Divisional Head द्वारा GDS को appropriate Medical Authority के सामने examination के लिए भेजा जाता है।
Medical Authority में, scheme के अनुसार, Civil Surgeon, District Medical Officer या Government Hospital के Medical Officer जैसे authorities शामिल हो सकते हैं।
- GDS fit है
- GDS permanently incapacitated है
- GDS less laborious character के suitable work के लिए fit है
अगर Medical Authority कहे कि GDS दूसरे काम के लिए Fit है?
यदि Medical Authority यह certify करती है कि GDS किसी कम laborious character के work के लिए fit है, तो 2025 scheme के अनुसार उसे voluntary discharge की अनुमति नहीं दी जाएगी और उसे alternative suitable post offer किया जा सकता है।
इसलिए medical-ground discharge automatic process नहीं है। Medical examination और Department द्वारा prescribed procedure महत्वपूर्ण हैं।
Medical Certificate के बारे में महत्वपूर्ण नियम
2025 के OM के अनुसार केवल ऐसा medical certificate जो Department की prescribed process और prior approval के बिना प्राप्त किया गया हो, अपने आप valid नहीं माना जाता।
इसलिए GDS को अपने स्तर पर medical certificate बनवाकर सीधे voluntary discharge claim करने के बजाय prescribed departmental procedure follow करना चाहिए।
Medical Voluntary Discharge की Competent Authority
2025 के revised medical scheme में सभी categories of GDS के लिए Divisional Head को voluntary discharge accept और approve करने की competent authority बताया गया है।
Scheme के अनुसार discharge की effective date request की acceptance की date होगी। Independent units जैसे GPO/Foreign Post Office आदि के लिए powers निर्धारित rank वाले Head of Unit द्वारा exercise किए जाने का provision भी दिया गया है।
क्या Medical Voluntary Discharge पूरी तरह Voluntary है?
हाँ। 2025 के revised scheme में स्पष्ट किया गया है कि scheme purely voluntary है और किसी GDS को इस scheme के तहत quit करने के लिए compel नहीं किया जाएगा।
क्या Pending Disciplinary Case में Medical Discharge मिल सकता है?
2025 के medical-ground scheme में यह restriction दी गई है कि scheme उन GDS के लिए उपलब्ध नहीं होगी जो Put Off Duty पर हैं या जिनके विरुद्ध disciplinary action या criminal action pending अथवा contemplated है।
इसलिए किसी वास्तविक case में employee की exact service स्थिति और applicable departmental instructions को verify करना जरूरी है।
Medical Voluntary Discharge के Benefits
2025 के OM के अनुसार normal discharge benefits engagement period के अनुपात में दिए जाने का provision है।
यदि GDS medical-ground voluntary discharge के समय 10 years की engagement period पूरी नहीं करता, तो 2025 scheme के अनुसार monetary benefits का entitlement नहीं होगा।
